Who are we?

'We', 'us' and 'our' refer to NZ Financial Services Group Limited of 22 Kings Crescent, Lower Hutt, New Zealand (trading under various brands including Loan Market) and our related businesses.

Our commitment to protect your privacy

We understand how important it is to protect your personal information. We recognise that any personal information we collect about you will only be used for the purposes we have collected it or as allowed under the law.

It is important to us that you are confident that any personal information we hold about you or your clients will be treated in a way which ensures protection of such personal information.

Our commitment in respect of personal information is to abide by the New Zealand Privacy Principles for the protection of personal information, as set out in the Privacy Act 1993 (the Privacy Act) and any other relevant law.

Why we collect your personal information

We collect your personal information when you choose to register with us to use our application. We also collect your personal information so that we can inform you of updates to the application, outages for maintenance, or to seek your feedback.

In addition we may collect aggregate information to monitor the usage of the application including pages visited and products quoted. This aggregated information may be passed to insurers that feature in the application.

How do we collect your personal information?

We collect your personal information directly from your use of our application. You are not required by law to provide any personal information to us but any failure to do so means that you will not be able to use this application.

Do we disclose your personal information?

We may disclose your personal information:

• to our employees, officers, related bodies corporate, contractors or service providers for the purposes of operation of our application or our business, fulfilling requests by you, and to otherwise provide products and services to you including, without limitation, web hosting providers, IT systems administrators, electronic network administrators, to companies that provide information and infrastructure systems to us;
• to anyone, where you have provided us consent;
• where we are required or authorised to do so by law, such as under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009;

We may use cloud storage to store the personal information we hold about you and your clients. The cloud storage and the IT servers may be located outside New Zealand.

Do we disclose your personal information to anyone outside New Zealand?

We may disclose personal information to related bodies corporate and third party suppliers and service providers located overseas for some of the purposes listed above, including the following:

• our data hosting and other IT service providers, located in various countries.

Your personal information may be stored in the cloud in an overseas country.

Direct marketing

From time to time we may use your personal information to provide you with current information about offers you may find of interest, changes to our organisation, or new products or services being offered by us or any company with whom we are associated.

If you do not wish to receive marketing information (whether through mail, email or telephone (including SMS/MMS), you may at any time decline to receive such information by telephoning us on 0508 87 87 88 or by writing to us at adviserservices@nzfsg.co.nz. If the direct marketing is by email you may also use the unsubscribe function. We will not charge you for giving effect to your request and will take all reasonable steps to meet your request at the earliest possible opportunity.

Our Application

Security

As our application is linked to the internet, and the internet is inherently insecure, we cannot provide any assurance regarding the security of transmission of information you communicate to us online. We also cannot guarantee that the information you supply will not be intercepted while being transmitted over the internet. Accordingly, any personal information or other information which you transmit to us online is transmitted at your own risk.

Updating your personal information

It is important to us that the personal information we hold about you is accurate and up to date. During the course of our relationship with you we may ask you to inform us if any of your personal information has changed.

If you wish to make any changes to your personal information, you may contact us. We will generally rely on you to ensure the information we hold about you is accurate and complete.

Access and correction to your personal information

We will provide you with access to the personal information we hold about you. You may request access to any of the personal information we hold about you at any time by contacting us at the details below.

If any of the personal information we hold about you is incorrect, inaccurate or out of date you may request that we correct the information. If appropriate we will correct the personal information at the time of the request.

Using government identifiers

We collect your FSPR number which is publicly available information. This helps us to identify you and to confirm that you are a financial adviser. If we collect any other government identifiers we do not use or disclose this information other than required by law.

How safe and secure is your personal information and the information that we hold on your clients?

We will take reasonable steps to protect your personal information and the personal information on your clients by storing it in a secure environment. We may store your personal information in paper and electronic form. We will also take reasonable steps to protect any personal information from misuse, loss and unauthorised access, modification or disclosure.

We will destroy or permanently de-identify personal information if it is no longer required for the purposes for which it was collected.

Complaints

If you are dissatisfied with how we have dealt with your personal information, or you have a complaint about our compliance with the Privacy Act, you may contact our privacy officer at adviserservices@nzfsg.co.nz.
